Former capt.Charles cherry and officer joseph pryor, who are black, and officer robert reyes, who is latino, alleged that they were fired because of their race.District judge thomas schroeder on monday dismissed cherry’s and pryor’s claims of disparate treatment but allowed reyes’ to continue.
The city argued that cherry’s claims should be dismissed because he could not show that employees who were in similar situations but not black received more favorable treatment. The judge agreed, but gave cherry 20 days to provide that information to the court.
In pryor’s case, the city argued that pryor failed to show that he was the victim of an"Adverse employment action. "
